1. Acceptance of Terms

These Terms of Service (the "Terms") are a legally binding agreement between you and Mahammadali Pashayev (operating as "MaGame", "we", "our", or "us") governing your use of the MaGame mobile application (the "App"), available on iOS and Android, and any related services.

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not use the App.

If you use the App on behalf of another person (for example, as a parent or guardian), you confirm that you have the authority to bind that person to these Terms.

2. Eligibility

You must be at least 13 years old to use MaGame. By using the App, you represent and warrant that you are 13 years of age or older.

If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may use the App only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. If you are between 13 and 16 years old and located in the European Union, parental consent may additionally be required under your country's laws, as described in our Privacy Policy.

You may not use the App if you have previously been banned from it or if your use of the App would violate any applicable law.

3. Accounts

3.1 Registration

You can use the App in two ways:

• Registered account — created by verifying your email address with a one-time password (OTP). No password is stored; access is granted via OTP codes sent to your email.
• Guest account — a temporary anonymous account that does not require an email address. Guest data may be lost if the App is uninstalled and cannot be recovered.

3.2 Account Accuracy and Security

• You agree to provide accurate information (including a valid email address that you own) and to keep it up to date.
• You are responsible for maintaining the security of the email account used to sign in, and for all activity that occurs under your MaGame account, whether or not authorized by you.
• You must not share, sell, transfer, or lend your account to anyone else, and you must not use another person's account.
• If you suspect unauthorized access to your account, notify us immediately at mahammadalipashayev@gmail.com.

3.3 One Account per Person

You may not create multiple accounts to manipulate leaderboards, evade bans or suspensions, or otherwise abuse the App.

4. Acceptable Use & User Conduct

MaGame is a party game built around playing together. To keep it fun and safe for everyone, you agree not to:

• Cheat or exploit — use bots, scripts, automation, mods, emulator manipulation, exploits, bugs, or any unauthorized third-party software to gain an unfair advantage, manipulate XP, levels, leaderboards, or game outcomes;
• Abuse the chat or other user-generated content (UGC) — online game rooms include chat and user-provided content (such as display names and avatars). You must not post content that is harassing, threatening, hateful, discriminatory, sexually explicit, violent, defamatory, or otherwise offensive or illegal;
• Harass other players — insult, bully, intimidate, stalk, dox, or impersonate other users or any third party;
• Spam or solicit — send unsolicited advertising, phishing links, malware, or repetitive disruptive messages;
• Interfere with the service — attempt to disrupt, overload, reverse engineer, decompile, or gain unauthorized access to the App, its servers, or other users' accounts and data;
• Defraud the ad system — generate fraudulent or automated ad views or interactions;
• Violate the law — use the App for any unlawful purpose or in violation of any applicable law or regulation.

4.1 User-Generated Content

You are solely responsible for any content you submit in the App (chat messages, display names, avatars, and similar). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to display, store, and transmit that content as necessary to operate the App (for example, showing your chat messages to other players in your game room).

You represent that your content does not infringe the rights of any third party and complies with these Terms.

4.2 Moderation and Enforcement

We reserve the right (but have no general obligation) to monitor, review, filter, or remove any user-generated content at our discretion, and to warn, mute, suspend, or permanently ban any user who violates this Section 4 or any other provision of these Terms — with or without prior notice. We may also report illegal content or conduct to the appropriate authorities.

5. Virtual Items, XP & Leaderboards

The App includes virtual features such as experience points (XP), levels, league tiers, leaderboards, in-game hints, and similar progression elements (collectively, "Virtual Items").

• Virtual Items have no monetary or real-world value. They are not currency, property, or any other form of asset.
• Virtual Items cannot be exchanged, redeemed, sold, transferred, or converted into money, goods, or anything of value, inside or outside the App.
• You receive only a limited, personal, non-transferable, revocable license to use Virtual Items within the App.
• We may modify, rebalance, reset, or remove Virtual Items, leaderboards, leagues, or progression systems at any time (for example, for game balance, seasonal resets, or anti-cheat enforcement) without liability to you.
• Virtual Items obtained through cheating, exploits, or fraud may be removed, and the associated account may be suspended or banned.
• Upon termination or deletion of your account, all Virtual Items associated with it are forfeited without compensation.

6. Advertising

The App displays rewarded video advertisements served by Google AdMob. These ads are strictly optional and opt-in: you choose whether to watch an ad in exchange for an in-game reward (such as a hint). We do not show banner or interstitial ads without your initiation.

• Watching an ad does not create any payment obligation between you and us.
• Ad availability is not guaranteed; rewarded ads depend on third-party ad inventory and may be unavailable at times or in certain regions.
• Advertisements are provided by third parties. We do not endorse and are not responsible for the content of third-party ads or for products and services advertised in them.
• Details on the data processed in connection with advertising, and how to limit ad tracking, are described in our Privacy Policy (Section 5.3).

7. Intellectual Property

The App and all of its content — including the MaGame name and brand, logo, app icon, artwork, graphics, design, user interface, game rules and mechanics as expressed in the App, text, software, and code (excluding user-generated content and third-party components) — are owned by Mahammadali Pashayev (MaGame) and are protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial entertainment.

You may not:

• copy, modify, distribute, sell, rent, lease, or sublicense the App or any part of it;
• use the MaGame name, logo, or other brand elements without our prior written permission;
• remove or alter any copyright, trademark, or other proprietary notices;
• reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law.

All rights not expressly granted to you in these Terms are reserved.

8. Termination

8.1 Termination by Us

We may suspend or terminate your account and your access to the App, in whole or in part, with or without notice, if:

• you violate these Terms (including the conduct rules in Section 4);
• we are required to do so by law or by a competent authority;
• continued provision of the App to you creates a security, legal, or technical risk; or
• we discontinue the App or any part of it (we will make reasonable efforts to give advance notice of a full discontinuation).

8.2 Termination by You

You may stop using the App at any time and may request deletion of your account and associated data as described in our Privacy Policy (Section 8 — Account Deletion): email us at mahammadalipashayev@gmail.com with the subject "Account Deletion Request".

8.3 Effect of Termination

Upon termination, your license to use the App ends, and all Virtual Items (XP, levels, league standing, leaderboard entries) are forfeited without compensation. Sections that by their nature should survive termination (including Sections 5, 7, 9, and 11) will survive.

9. Disclaimers & Limitation of Liability

9.1 "As Is" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT YOUR GAME DATA WILL NEVER BE LOST.

The App is a free entertainment product. We do not guarantee the availability of online multiplayer rooms, leaderboards, rewarded ads, or any specific feature at any given time.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR GAME PROGRESS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP;
• OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (THE APP IS CURRENTLY FREE), OR (B) FIFTY US DOLLARS (USD 50).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent (wilful misconduct) or gross negligence, or your statutory rights as a consumer. We are not responsible for the conduct of other users, whether in chat, game rooms, or otherwise, although we will enforce these Terms as described in Section 4.2.

9.3 Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your user-generated content, or your misuse of the App.

10. Changes to These Terms

We may update these Terms from time to time, for example to reflect new features, legal requirements, or changes to our practices. When we make material changes, we will notify you by:

• updating the "Last updated" date at the top of this page; and
• displaying a notice within the App where appropriate.

Your continued use of the App after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and may request account deletion as described in Section 8.2.

11. Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or the App, are governed by the laws of the Republic of Azerbaijan, without regard to its conflict-of-law rules.

The courts of Baku, Azerbaijan shall have jurisdiction over such disputes, except where mandatory consumer protection laws of your country of residence grant you the right to bring proceedings in, or rely on the laws of, that country. Nothing in this Section deprives you of protections afforded by mandatory provisions of the law of your habitual residence.
